These Terms of Sale apply to purchases made through Canadian Pharmacy Spot. They explain when an order becomes binding, how prescription orders are reviewed, and what happens if a product cannot be supplied or delivered.
By placing an order, you agree to these Terms.
Order Acceptance
Placing an order on our website does not mean that the order has been accepted.
Your order is a request to purchase the products listed at checkout. An automated email, payment authorization, or confirmation that we received your order is not final acceptance.
For prescription medication, the purchase can proceed only after the prescription has been reviewed and approved for dispensing by a pharmacist and the order has been accepted by the applicable dispensing pharmacy.
Canadian Pharmacy Spot or the pharmacy responsible for dispensing may decline all or part of an order where:
- a prescription cannot be verified or lawfully filled;
- pharmacist approval cannot be obtained;
- the medication is unavailable;
- the requested quantity cannot be supplied;
- the order contains incorrect or incomplete information;
- pharmacy services cannot lawfully be provided to the patient’s location;
- the destination is subject to legal or shipping restrictions;
- there is a material pricing or website error; or
- we reasonably suspect misuse, fraud, or another unlawful transaction.
Nothing on the website requires a pharmacist to dispense a medication contrary to applicable law, professional standards, or professional judgment.
If an order is declined after payment has been collected, the amount paid for the affected item will be refunded.
Medication Availability
Products shown on the website are subject to availability. A medication may become unavailable because of manufacturer supply, a drug shortage, inventory changes, regulatory restrictions, or other circumstances outside our control.
We do not guarantee that an item shown online is in stock at the time an order is reviewed.
If a medication is unavailable, we may contact you about an available alternative, place the order on hold with your agreement, or cancel the affected item and issue the appropriate refund.
Prescription Review and Approval
Prescription medications are dispensed only when the pharmacy responsible for dispensing has received a prescription that it can lawfully fill and a pharmacist has determined that dispensing the medication is appropriate.
A pharmacist may need to verify the prescription, contact the prescriber, confirm patient information, or request additional information before approving an order.
Submitting a prescription does not guarantee that it will be filled. A pharmacist may refuse or delay dispensing where required by law, professional standards, patient safety, or professional judgment.
Drug Prices
The price displayed when you place an order is subject to verification before the order is accepted.
Prescription pricing may depend on the medication, strength, quantity, manufacturer, dispensing fee, and other applicable pricing requirements.
If a material pricing error or unexpected price change is identified before the order is accepted, we will provide the corrected price before proceeding. You may then continue with or cancel the affected item.
We may change website prices at any time, but a later price change will not affect an order that has already been accepted unless required by law.
Taxes
Taxes are applied where required by law and are calculated according to the product and delivery destination.
Prescription drugs and qualifying dispensing services are generally zero-rated for GST/HST in Canada. Non-prescription products and other pharmacy items may be subject to GST, HST, provincial sales tax, or other applicable taxes.
International customers may also be responsible for import taxes, customs duties, brokerage charges, or similar fees imposed by the destination country.
Shipping and Delivery
Orders are shipped only after all required pharmacy, prescription, and payment checks have been completed.
Delivery dates shown on the website or provided by a carrier are estimates. Delays may occur because of weather, carrier operations, customs processing, drug supply, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address or an unsuccessful delivery may be charged where permitted by law.
Some medications require specific storage or temperature conditions. We may restrict the shipping method or destination if those conditions cannot be maintained safely.
For pharmacy services provided from Alberta, dispensing and delivery are also subject to the requirements that apply to pharmacy practice and care provided at a distance. We do not guarantee that every medication can be dispensed or shipped to every location.
Order Cancellations
Contact us as soon as possible if you need to cancel an order.
Orders can normally be cancelled before dispensing or shipment has begun. Once a prescription has been dispensed or an order has entered final preparation for shipment, cancellation may no longer be possible.
If we cancel an order before it is supplied, any amount collected for the cancelled item will be refunded.
Nothing in this section limits any cancellation right that you may have under the Alberta Consumer Protection Act, the Internet Sales Contract Regulation, or other applicable consumer protection law.
Refunds and Returns
For medication safety, dispensed medications generally cannot be returned to pharmacy inventory or resold after they have left the pharmacy.
Prescription medication is therefore normally non-returnable and non-refundable once it has been dispensed and supplied, except where the medication was supplied incorrectly, arrived damaged or defective, was subject to a recall, or a refund is otherwise required by law.
If you believe there is a problem with medication you received, contact us before using it whenever possible. Do not mail medication back unless you are instructed to do so.
Refunds for eligible non-prescription products are handled according to the condition of the product and applicable law.
These terms do not limit any refund or other remedy available under applicable consumer protection law.
Unable to Fulfill an Order
If we cannot complete an order, we will notify you and cancel or adjust the affected portion of the order.
This may happen because a medication is unavailable, a prescription cannot be approved, required information cannot be verified, pharmacy services cannot be provided to your location, a shipping destination cannot be served, or fulfillment would not comply with applicable law or pharmacy standards.
Any amount collected for medication that is not supplied will be refunded using the original payment method where possible.
Medication Substitution
A pharmacist may dispense an interchangeable generic medication or a product from a different manufacturer when substitution is permitted by the prescription and applicable law.
Any substitution must be clinically appropriate and meet the requirements that apply to the dispensing pharmacy.
A change that requires authorization from the prescriber will not be made without that authorization. If an available alternative materially changes the price or requires a decision from you, we will contact you before completing the order.
You may request a particular brand or manufacturer where available. This may affect availability, price, insurance coverage, or the pharmacy’s ability to fill the prescription.
International Orders
International orders are accepted only where the medication, prescription, dispensing arrangement, and shipment comply with the laws and professional requirements that apply to the order.
Depending on the medication and destination, an eligible order may be dispensed or fulfilled through Canadian Pharmacy Spot or through a separately operated pharmacy or fulfillment provider in another jurisdiction. The applicable pharmacy must be permitted to process and supply the order.
Prescription and import requirements differ between countries. We may require additional prescription, identity, or shipping documentation before an international order can be accepted.
The customer is responsible for confirming that the medication may legally be imported, possessed, and used in the destination country. Customs authorities may inspect, delay, return, seize, or refuse a shipment.
We cannot guarantee customs clearance or a specific international delivery date.
Controlled substances, narcotics, and other medications subject to export, mailing, or destination restrictions will not be shipped where shipment is prohibited.
Unless required by law or the failure resulted from our error, medication that has been properly dispensed and shipped is not refundable solely because customs authorities delayed, refused, seized, destroyed, or returned the shipment.
Applicable Law
These Terms are governed by the laws of Alberta and the applicable federal laws of Canada, subject to any mandatory laws that apply to a customer or transaction in another jurisdiction.
Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded under applicable consumer protection, pharmacy, or other legislation.
